The Evolution Host Terms of Service are requirements the client must adhere to in order for service to be provided by Evolution Host or any Evolution Host entity.
Failure to comply with the Evolution Host Terms of Service may result in cancellation of service and/or further appropriate action being taken.
Evolution Host services must not be used to perform or solicit any malicious activities. If a customer uses their
server for malicious purposes or to cause harm to us or any third party, we reserve the right to suspend that user's account immediately and without refund.
Pornography and other immoral content is strictly forbidden at Evolution Host. Evolution Host retains the right to
determine what is immoral.
Content related to "drugs" are allowed at Evolution Host as long as it does not encourage the use of unbeneficial,
inorganic or unhealthy drugs. Evolution Host encourages the use and promotion of natural remedies but strictly forbids the
promotion of drug or alcohol abuse.
The use of IRCd networks is allowed, however if this causes a problem in any fashion, Evolution Host reserves the right to cancel this service at any point.
Any content promoting war/warmongering is deemed immoral.
Mail spam is strictly prohibited at Evolution Host. Any VPS (or any service) user mail spamming will be automatically detected and automatically suspended. Refunds will not be granted for any user that mail spams or abuses the ToS in any way.
Evolution Host do not offer managed services. It is therefore the client's responsibility to utilise their services accordingly. We will make sure that your service is fully functional and operating as advertised. Additionally, we will correct any issues that arise with our systems. It is the client's responsibility to maintain their own server, for example, we are unable to edit your configuration files and troubleshoot your scripts.
The Evolution Host account balance system is designed to improve the refundability of our products and services. If you choose to cancel a service, Evolution Host support can easily return the funds for the unused duration of the subscription. Refunds will only be given in account balance form.
In order to guarantee the continued operation of your services, your invoice must be paid before or up to three days after the stated date. Evolution Host does not store any customer payment details. All payments are processed externally for customer security. The only way in which automatic recurring payments can be setup is through a PayPal subscription which will need to be cancelled in your PayPal account when you wish to cancel your service to avoid it sending us any further payments.
All services ran under Evolution Host must be done so without effecting other clients which may be on the same system. An example of this would be binding your IRCd to all available addresses on the network. This is strictly prohibited and can lead to account termination if warnings are ignored.
Evolution Host will not be held responsible for the backing up and integrity of client data. The backing up and securing of client files/data is the sole responsibility of the client, not Evolution Host. Evolution Host is not responsible for any money/funds/any form of currency stored on Evolution Host servers. Evolution Host will not be held liable for any attacks against your/our service. It is your duty to secure your funds.
In any situation where your service is hijacked, hacked or compromised in any regard, Evolution Host will not be held responsible for this occurrence. It is the client's responsibility to keep all their personal details and passwords secure and personal.
While there are no limits to the allocated disk space for game servers and mIRC Bots, a fair usage policy is applied. In the case of game servers, your fair usage allocation is dependant upon the amount of player slots/RAM you have ordered for your server. The higher the amount, the more you can store on your account without being effected by the fair usage policy.
All live support sessions are monitored for training and quality purposes. We reserve ownership rights over the conversation and therefore its content. We may use any part of this conversation for training, advertising or any other purposes.
Evolution Host reserve the right to refuse business from any person. This is only applied when Evolution Host have reason to be suspicious of the intent of the individual. Whether it be potential of staff abuse or malicious intentions.
Threatening or disrespecting Evolution Host staff at any time is strictly forbidden. We reserve the right to take appropriate action against any abusive client. Evolution Host reserve the right to refuse support to any client making unreasonable demands. A fair usage policy is applied to all support facilities. Should the client's interactions be deemed unnecessary, excessive or obstructive, support may be refused.
Evolution Host reserves the right to change or alter our terms/policies at any time. It is the client's responsibility to check our terms regularly for any updates/changes.
